PART I – PRIVACY POLICY

2. General Information
This Privacy Policy explains how personal data is processed when using the CaptAIdea mobile application (“App”).
We process personal data strictly in accordance with the GDPR and applicable German data protection laws.

3. Categories of Personal Data
3.1 Account Data
When registering an account, we process:
Email address
Username (if provided)
Encrypted authentication credentials
Purpose: Account management and authentication
Legal basis: Art. 6(1)(b) GDPR (performance of contract)

3.2 AI Feature Usage
When using AI-powered features:
User prompts and submitted text are transmitted to OpenAI’s API
AI inputs are processed in real-time
AI inputs are NOT stored on our servers
We do not retain AI input content after processing
Purpose: Providing AI-generated responses
Legal basis: Art. 6(1)(b) GDPR
We do not use AI inputs for analytics, profiling, or advertising.

3.3 Subscription Data
Subscriptions are processed exclusively via Apple’s App Store.
We do not collect or store:
Payment details
Credit card numbers
Billing information
We only receive subscription status information necessary to enable premium features.

4. No Analytics, No Tracking
We do not use:
Analytics services
Tracking technologies
Advertising networks
Profiling tools
We do not create user behavior profiles.

5. Server Location & Hosting
All account-related data is stored on secure servers located in Germany.
Data is processed within the European Union.
No data is transferred outside the EU, except when interacting with OpenAI’s API (see Section 6).

6. Use of OpenAI (Processor)
To provide AI functionality, user inputs are transmitted to OpenAI.
OpenAI may process data in the United States or other third countries.
Appropriate safeguards pursuant to Art. 44 ff. GDPR apply (e.g., Standard Contractual Clauses).

We do not store AI input data on our servers.

7. Data Security (Art. 32 GDPR)
We implement appropriate technical and organizational measures:
TLS/HTTPS encryption
Secure server infrastructure in Germany
Restricted access controls
Encrypted credential storage

8. Data Retention
We retain account data:
For the duration of the contractual relationship
Until deletion is requested
As required by statutory retention obligations
AI input data is not stored.

9. User Rights (Art. 15–22 GDPR)
You have the right to:
Access your personal data (Art. 15)

10. Automated Decision-Making
We do not conduct automated decision-making within the meaning of Art. 22 GDPR.

11. Children
The App is not intended for children under 16 years within the EU.
We do not knowingly collect data from minors.

12. Changes to This Policy
We reserve the right to update this Privacy Policy.
The current version is always available on our website.

PART II – TERMS OF SERVICE

13. Acceptance of Terms
By using the App, you agree to these Terms of Service.

14. Description of Service
CaptAIdea provides AI-assisted functionality via OpenAI integration.
The service is provided “as is” without guarantees of accuracy or completeness.

15. User Accounts
Users are responsible for:
Maintaining confidentiality of login credentials
All activity under their account
We may suspend accounts in case of misuse.

16. Subscriptions
Subscriptions are managed exclusively via Apple’s App Store.
Billing and cancellation are handled by Apple
Refunds are subject to Apple’s policies
We do not process payments directly.

17. Acceptable Use
Users may not:
Use the App for illegal purposes
Submit unlawful or harmful content
Attempt to disrupt system security
Violation may result in termination.

18. Intellectual Property
All rights to the App remain with Karsten Hinn.
Users retain ownership of their submitted content.
AI-generated outputs are provided without warranty.

19. Limitation of Liability
We are liable only for intent and gross negligence, unless mandatory statutory provisions provide otherwise.
Use of AI-generated content is at the user’s own risk.

20. Governing Law
This agreement is governed by the laws of the Federal Republic of Germany.
Consumer protection laws of the user’s country of residence remain unaffected.
